New federal privacy legislation, called the Personal Information Protection and Electronic Documents Act (PIPEDA) will require that every architectural practice create and implement a privacy policy by January 1, 2004. Failure to comply may result in severe sanctions including a court order requiring the practice to pay damages. Details about the breach and implementation of this new legislation should be available through architects’ provincial associations. In Ontario, for instance, the Ontario Association of Architects will develop a model policy that can be adapted by the majority of practices to help them comply with the new law. Some instances of failure to comply could result in a charge of professional misconduct under the Architects Act.
